A Study on the Precedent Trends and Implications to Prevent Abuse at Welfare Facilities for Persons with Disabilities

    Abstract

    The objective of this study was to analyze judicial precedents of abuse cases for disabled people in Korea’s welfare facilities and provide basic data for preventing abuse and coming up with countermeasures. To that end, 12 cases of the first trial, 3 cases of a trial on an appeal case, and 3 cases of an appellate court related to abuse cases were analyzed. This study found that in welfare facilities for disabled people, sexual abuse and physical abuse occurred the most. Major abusers were facility operators and teachers for daily rehabilitation while major victims were intellectually disabled people. As for the ruling, prison sentence accounted for the most part. Out of 15 abusers, 9 were sentenced to prison and 6 had probation sentence. Regarding sexual abusers, along with prison sentence in most cases, sexual violence treatment program and information disclosure sentence were made in parallel. With regard to physical abusers, prison sentence or probation and social volunteer order were made. Based on these research results, effective measures are needed to enact 「The Act for preventing abuse of disabled people」, prevent abuse and human rights violation in welfare facilities for disabled people, and prevent and respond to sexual abuse of mentally and intellectually disabled people.
